The law in brief

Who does Law No. 100/2026 protect?

Drivers of trucks over 12.5 tonnes maximum authorised mass in commercial road freight. The carrier must deliver the goods, but the driver is not responsible for loading or unloading by default.

When may a driver still handle the cargo?

Only with voluntary, explicit written consent and in line with occupational safety rules. Specialised transport has a narrow exception: the operation must objectively require it, and the duty must be explicitly stated in the employment contract or an addendum.

How is the combined exposure calculated?

Minimum = 5,000 × number of counterparties + 10,000 × number of unlawful carrier clauses. Maximum = 20,000 × total number of breaches. The competent authority sets the final amount.
